Michigan lawmakers propose legislation that would allow for change of sex identification on birth certificate

LANSING, Mich – Michigan House Bill 5303 would amend the Public Health Code of 1978 in Michigan by modifying sections 2831 and 2872.

Section 2831 outlines the conditions under which a new birth certificate may be established, including adoption reports, requests for paternity establishment, and requests for a new certificate reflecting a different sex designation.

Section 2872 details the procedures for creating a new birth certificate to show paternity, changing the surname of a child, and updating an individual’s name on the certificate through a court order.

The bill introduces specific provisions related to sex designation changes, paternity acknowledgment, and name changes on birth certificates.

The bill was introduced on November 3, 2023 and was referred to the committee on judiciary.

There has been no further movement on the legislation.
